Typographical Errors

If your credit card has already been charged for the purchase and your order is cancelled, Fear No Tuna shall issue a credit to your credit card account in the amount of the incorrect price.

Term; Termination

These terms and conditions, or any part of them, may be terminated by Fear No Tuna without notice at any time, for any reason. Guarantees

Fear No Tuna does not offer refunds or pro-rated refunds on weekly or monthly subscription. If you purchase a 6 month or 1 year FearNoTuna.com membership and for some reason you decide that you would like a refund, you have 30 days fromt he date of purchase to request a refund in writing. If you request a refund within 30 days from the date of purchase, Fear No Tuna will give you a pro-rated refund of your purchase price. If you do not request a refund within the 30 day refund period, you forfeit this option and will not be eligible for a refund. We do not offer refunds on any additional services or third party transactions that you may purchase in the members area once you are a member.

Mediation

Your use of this site shall be governed in all respects by the laws of the state of Cailifornia, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You also agree that, in the event any dispute or claim arises out of or relating to your use of the FearNoTuna.com, Bubba's Hotrods' products or service, or this Policy that you and Fear No Tuna will attempt in good faith to negotiate a written resolution of the matter directly between the parties. You agree that if the matter remains unresolved for forty-five (45) days after notification (via certified mail or personal delivery) that a dispute exists, all parties shall join in mediation services in Los Angeles, California with a mutually agreed mediator in an attempt to resolve the dispute. Should you pursue or file any class actions, arbitration claims, or any administrative or legal actions without first having attempted to resolve the matter by mediation, then you agree that you will not be entitled to recover attorneys’ fees, even if you would otherwise be entitled to them.

You agree that any subsequent civil action, class action, or legal proceedings will be that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Fear No Tuna products or services) shall be in the state or federal courts located in Los Angeles County, California. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Fear No Tuna products) must be commenced within one (1) year after the claim or cause of action arises. Fear No Tuna's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Fear No Tuna may assign its rights and duties under this Agreement to any party at any time without notice to you.
